Web Hosting Terms of Service
These Terms of Service ("Agreement") govern the use of web hosting services ("Services") provided by 815 Media ("Company") to the customer ("Customer"). By using our Services, you agree to abide by the terms and conditions outlined below.
1. Account Setup and Maintenance
1.1. Customer Account: The Customer agrees to provide accurate and complete information during the account setup process. It is the Customer's responsibility to keep their account information up-to-date.
1.2. Account Security: The Customer is responsible for maintaining the security of their account, including their login credentials and any access keys provided by the Company.
2. Payment and Billing
2.1. Fees: The Customer agrees to pay the fees associated with the selected web hosting package as outlined on the 815 Media website or as agreed upon in a separate agreement.
2.2. Payment Due Date: Payment for Services is due on the date specified upon account activation and each subsequent billing cycle.
2.3. Non-Payment: In the event of non-payment, the following actions will be taken:
- After 2 weeks of non-payment, the Customer's account will be suspended. During suspension, the website and associated services will be unavailable.
- After 30 days of non-payment, the Customer's account and all associated data will be deleted. To recover files, the Customer will be required to pay a restoration fee as specified by 815 Media.
2.4. Payment Methods: 815 Media accepts various payment methods, including credit cards and electronic funds transfers, as indicated on the 815 Media website.
3. Termination and Cancellation
3.1. Termination by Customer: The Customer may cancel their Services at any time by providing written notice to 815 Media. Refunds, if applicable, will be subject to 815 Media's refund policy.
3.2. Termination by Company: 815 Media reserves the right to terminate or suspend Services without prior notice if the Customer violates any terms of this Agreement or engages in unlawful or inappropriate behavior.
3.3. Cancellation and Refunds
3.3.1. Cancellation by Customer: The Customer may cancel their Services at any time by providing written notice to 815 Media. Refunds, if applicable, will be subject to 815 Media's refund policy.
3.3.2. Early Termination Credit: In the event that the Customer chooses to cancel their Services before the end of the year from the date of account activation, no refunds will be provided. Instead, the Customer will be eligible for a credit that can be applied to future services offered by 815 Media. The credit amount will be calculated based on the remaining months in the year and the monthly cost of the Service plan subscribed to by the Customer.
3.3.3. Termination by Company: 815 Media reserves the right to terminate or suspend Services without prior notice if the Customer violates any terms of this Agreement or engages in unlawful or inappropriate behavior.
4. Data and Files
4.1. Data Backup: The Customer is responsible for maintaining backup copies of their website files and data. 815 Media recommends regular data backups to prevent data loss.
4.2. Restoration Fee: In the event of account deletion due to non-payment, a restoration fee will be required to recover files. The restoration fee will be determined by 815 Media and communicated to the Customer.
5. Limitation of Liability
5.1. 815 Media shall not be liable for any damages or losses arising from the use or inability to use the Services, including but not limited to data loss, business interruption, or any direct, indirect, incidental, or consequential damages.
6. Changes to Terms of Service
6.1. 815 Media reserves the right to modify or update these Terms of Service at any time. Changes will be effective upon posting on the 815 Media website. Continued use of the Services after changes are made constitutes acceptance of the modified terms.
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our Services.
